TIDAL WALK HOMEOWNER’S ASSOCIATION OWNERS, GUEST AND TENANT RULES

The amenities of TIDAL WALK are for the EXCLUSIVE use of TIDAL WALK owners and their guests/tenants only. The Association is not responsible for accidents, injuries, or death. Use of all amenities and facilities are at your own risk.
Parents are responsible for actions of their children. Owners are responsible for their tenants and guests.
This document summarizes the community governing rules that are most applicable to owners, guests and tenants, and additional community guidelines to ensure enjoyment for all. This document is subject to change at the discretion of the Home Owner’s Association (HOA).
TRASH: Trash and recycle receptacles are provided. All trash must fit within the receptacles. Trash is picked up every Tuesday and recycling is picked up every other week. Memorial Day – Labor Day recycle will be weekly.
Recycle is comingled; therefore, place all recycle materials in the recycle canonly. Do not place trash in the recycle can as it will not be picked up.
CCR Section 24: Receptacles may not be placed at the street more than 24 hours prior to the time of pickup and must be removed from the street within 24 hours of pickup.
CLOTHESLINES: Clotheslines are prohibited outside the home. No towels, clothing or other items of any kind, except flower boxes with flowers, may be hung on railings or be exposed for airing or drying.
VEHICLES: The following types of vehicles are not permitted to be stored in open view: motorcycle, boat, personal watercraft or boat trailer, motor home, mobile home, trailer, self-contained camper or fifth wheel vehicle, any truck with a camper slip-on where the camper is higher than the roofline of the truck’s cab, any other type vehicle that is not normally used for daily transportation, including dune buggies, ATV’s, non-operational or other auto equipment not licensed for use on public roads.
CCR Section 21: No automobiles, trucks under fifteen (15) tons GVW, vans, recreational vehicles, boats or any other vehicles or equipment of a similar nature shall be allowed on any Lot for more than fifteen (15) days during any twelve (12) month period unless they display a valid current license or registration, or are stored in a garage and out of public view.
No disabled or unlicensed vehicles may be kept in view on the property.
Any vehicle with commercial signs, advertising or visible commercial equipment, bus (private, public or church) and any vehicle that is not in service or good repair is prohibited.
PARKING: Owners, guests and tenants should park exclusively within their garages or driveways.
CCR Section 19: Parking on community roadways shall be permitted on a temporary basis only, for a period not to exceed forty-eight (48) hours. Long term and/or regular parking on community roadways is strictly prohibited.
Driving on common areas, lawns and grass is prohibited and will result in the responsible party charged for repairs, and if caused by a tenant, not only will the tenant be financially responsible but will be required to vacate the rental immediately and future rentals by that party will be denied. No parking on grass or wetland areas.
PROHIBITED STORAGE: Beach chairs and other equipment (such as fishing gear, umbrellas, kayaks, boats, flotation devices, etc.) may not be stored in the front, side,rear of the home.
CCR Section 23: No equipment or machinery (including, without limitation, equipment or machinery for use in connection with the maintenance of any dwelling) shall be stored in the front, rear or side yard of any Lot, except if stored within a Structure approved by the TWARC.
NOISE RESTRICTION: Please respect your neighbors’ right for peaceful enjoyment. To ensure the maximum enjoyment of the community, quiet should prevail between the hours of 10:00 pm to 7:00 am. Fireworks are always strictly prohibited and may not be discharged or stored anywhere within the community boundaries.
CCR Section 15: No noxious or offensive activity shall be permitted upon any Lot, nor shall anything be done thereon tending to cause embarrassment, discomfort, annoyance, or nuisance of the Property.
PETS: Pets must always be leashed and under the control of an adult when in the community.
Ocean View Code 68-2/6:
Pet owners are responsible for the clean-up and disposal of pet waste from any place within the community. Pets shall not be permitted to frequently or for long periods of time bark or make noise that disturbs any person in the vicinity.
CCR Section 15: The keeping of any non-domestic animals shall be deemed a nuisance per se under this section; but the keeping of domestic cats and dogs, or other traditional household pets, unless

Ocean View. Any domesticated animal shall not be considered to be running at large if it is on a leash
and under the control of a person physically able to control it.
the activity of such pets is in any way noxious, dangerous, unsightly or unpleasant, shall not be prohibited under this section.
No more than 3 domestic cats/dogs or other traditional household pets.
The keeping of Pit Bulls or Staffordshire terriers is prohibited. Dog houses and dog runs are not allowed. Aggressive dogs or dogs trained for protection will not be permitted.
DRIVING SPEED: Please drive slowly within the community for the safety of children and pedestrians, bikes, and pets. Speed limit is 15mph.
POOL AREA RULES: The pool is open from Memorial Day to Labor Day. The HOA reserves the right to shorten or extend the pool season as needed. Pool hours are 10am-8pm.
There are no lifeguards or attendants on duty at the pool. Use of any and all facilities is at your own risk. The HOA is not responsible for accidents, injuries, or death on Tidal Walk property.
Glass containers are strictly prohibited.
Children younger than 14 must be always accompanied by an adult at least 18 years of age.
The pool fobs are provided to owners. Tenants will receive the pool fobs from the owner from whom they are renting. Each residence will receive 2 (two) pool fobs. Replacement fobs will cost $75.00 per pass.
Owners, Guests and Renters are NOT to open the pool gate/community center for unknown persons.
Tenants may use the pool only at the commencement of their rental agreement through the end of the rental agreement.
Only Tenants covered by the rental agreement have access to the pool. Tenants may NOT invite outside guests to the pool.
Chairs, loungers and tables cannot be reserved for owners, guests or tenants who are not on the pool premises.
Chairs are to be removed from the wading pool area and umbrellas closed and tied when leaving the pool.
Children in diapers must wear swim type diapers in the pool at all times. Proper swim attire must be worn at all times.
Persons with infections, communicable diseases, open wounds or bandages areprohibited from pool. No pets are allowed at the pool or clubhouse.
No diving, running, or horseplay allowed. No smoking is permitted in the pool or poolarea.
Pool accessories are permitted as long as they do not interfere with the safety or disturb others. Keep pool area clean: Take all your trash with you when departing the pool.
The pool and pool apron must be vacated during thunder and/or lightning storms and for 30 minutes after the last occurrence.
When leaving the pool for more than 30 minutes, please take your belongings with you.
The pool house/clubhouse restrooms are available for use while at the pool. All persons are to towel excess water off before entering the pool/clubhouse.
OTHER RULES:
Window Treatments CCR Section 25: Bed sheets, plastic sheets, newspapers, plastic storm windows or other similar window treatments shall not be hung or place in or on any window on any dwelling located on any Lot.
Outside Holiday décor:
Thanksgiving and Christmas, no decoration outside prior to November 15 and must be removed no later than January 30th of the following year.
Other non-traditional holidays i.e., New Year’s , Valentine’s Day, St Patrick’s Day Easter, Memorial Day, July 4th, Labor Day, Halloween or others not listed. All decorations are limited to one week prior and must be removed one week after the holiday.
The operation of aerial drones within the Tidal Walk community is prohibited. No fishing in the pond.
Do not disturb or feed wildlife.
